Conditions of participation and data protection information for competitions
The organizer of the Instagram sweepstakes is Lampenwelt GmbH, Seelbüde 13, 36110 Schlitz (hereinafter Lampenwelt and/or "we").
This sweepstakes is not affiliated with Instagram and is in no way sponsored, supported or organized by Instagram. The recipient of the information provided by the participant is not Instagram, but Lampenwelt GmbH.
Participation in the sweepstakes is exclusively subject to the terms and conditions set forth herein. By participating in the sweepstakes, these terms and conditions are expressly accepted.
Any natural person who is at least 16 years old and resides in Germany is eligible to participate. Excluded from this are employees of Lampenwelt GmbH and their respective family and household members.
The participation takes place via Instagram. In order to participate in the sweepstakes, participants must within the participation period
mark the "raffle" post with "like" and
follow the account @lifeatlampenwelt on Instagram and
tag/link another person under the "Sweepstakes" post.
Participation in the sweepstakes is free of charge.
Closing date/number of possible entries.
The sweepstakes will run from 09/08/2022 10:00 AM until 09/10/2022 at 3:30 PM; unfortunately, late entries, regardless of the reason, will not be considered. Participation is only permitted once per eligible person.
Among all participants, we will draw 4 lamps of the brands Philips Hue worth 180€ (2 lamps), Reality Leuchten worth 99,90€ (1 lamp) and Lindby worth 79,90€ from our online store (www.lampenwelt.de) on 10.09.2022.
The winners will be determined after the closing date as part of a random draw among all participants.
The winners will be publicly linked in the Instagram live stream with their Instagram name.
Insofar as a winner does not report back within two weeks after notification of the prize by Lampenwelt, Lampenwelt is entitled to draw another winner.
The prize will be handed over at the Fulda office (Rabanusstrasse 14-16, 36037 Fulda) exclusively to the winner or the winner's legal representative.
Cash payment/exchange/assignment
An exchange, assignment or cash payment of the prize is not possible.
Lampenwelt reserves the right to change the sweepstake period at any time and without prior notice or to terminate the sweepstakes without notice for good cause, e.g. if the functionality of Lampenwelt's systems should be limited for technical or other reasons independent of Lampenwelt or if the suspicion should arise that a participant is attempting to influence the results of the sweepstakes.
Participation via automated procedures or other manipulations or such attempts (also by third parties) is not permitted, nor is the violation of the conditions of participation or an attempt in this regard. In the aforementioned cases or in the event of suspicion in this regard, Lampenwelt has the right to exclude a participant from the competition, to subsequently deny or reclaim winnings.
Insofar as users become active within the scope of the competition through their own contributions, they undertake not to upload any videos, photos or texts that infringe the copyright, personal rights or trademark rights of third parties or that violate competition law or other laws. Furthermore, they undertake to respect the right to their own image and not to upload photos of persons who have not given them their express consent. The legal responsibility in this respect lies exclusively with the participants.
Lampenwelt shall not be liable for any direct, indirect, special losses and/or damages of the participants arising from their participation and related to any malfunction in the communication or power lines, failures in the mobile operators, effects of harmful software, unfair acts of third parties aimed at unauthorized access and/or disabling of the software and/or hardware of Lampenwelt, as well as circumstances of force majeure. In such cases, Lampenwelt is not obligated to reimburse any losses incurred by the participant.
Lampenwelt is liable to the Participant for culpably caused damages from injury to life, body or health, for damages caused intentionally or grossly negligently by Lampenwelt, the legal representatives or vicarious agents of Lampenwelt, as well as for damages from a breach of a warranty given to the Participant without limitation according to the statutory provisions. Otherwise, Lampenwelt is only liable for the slightly negligent breach of obligations, the fulfillment of which makes the proper implementation of the campaign possible in the first place and on the compliance with which the participant may regularly rely (cardinal obligations), and this is limited to the foreseeable damage typical for the contract. The above limitation of liability applies accordingly to the personal liability of the legal representatives and vicarious agents of Lampenwelt.
Data protection information for participation in Instagram competitions
The person responsible for processing the personal data of the participants in the context of the sweepstakes on the Instagram account of Lampenwelt pursuant to Art. 4 (7) DSGVO is Lampenwelt GmbH, Seelbüde 13, 36110 Schlitz.
Participants can reach Lampenwelt's data protection officer at any time by emailing datenschutz@lampenwelt.de if they have any concerns about data protection.
Purpose and legal basis of the processing of personal data and storage period
To participate in the competition, it is necessary to enter the user name with which the participant is registered on Instagram. If a participant is drawn as the winner of the competition, we will contact the person via Instagram and require the full name for the handover of the prize. The participating person is responsible for the accuracy of the data provided.
The legal basis for the processing of personal data in the context of the sweepstakes is Art. 6 para. 1 lit. b DSGVO. The personal data provided will be collected and processed by Lampenwelt exclusively for the participation, implementation and execution of the sweepstakes. Personal data will not be passed on to third parties who are not involved in the organization of the sweepstakes.
The winner's data (full name, e-mail address) will be stored for a period of one month after the end of the competition for the purpose of clarifying any questions regarding the prize or the prize processing and will then be deleted.
According to the GDPR, participants have the right to obtain information about the personal data concerning them at any time (Art. 15 GDPR) as well as the right to correct incorrect or incomplete personal data concerning them (Art. 16 GDPR). In addition, the immediate deletion in one of the cases listed in Art. 17 DSGVO or the restriction of processing (Art. 18 DSGVO) may be requested. Furthermore, participant:s have the right to complain to a supervisory authority.
To assert the existing rights against Lampenwelt, an informal message to Lampenwelt GmbH, Seelbüde 13, 36110 Schlitz / Germany or to datenschutz@lampenwelt.de is sufficient.
We ask the participants to note that participation in the competition may no longer be possible if their data is blocked or deleted.
Should individual provisions of these conditions of participation and data protection information be invalid or contradict the legal regulations, the remaining conditions shall not be affected by this. In this case, the statutory provisions shall apply. The same applies to the closing of a contractual loophole. Legal recourse is excluded.
